1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Draft My Lesson, available at draftmylesson.com, an AI-powered lesson planning tool for teachers. Draft My Lesson is operated by JD Michael Casanova, an independent developer. By creating an account or using the service, you agree to be bound by these Terms in their entirety. If you do not agree, you must not use the service.

2. Description of Service

Draft My Lesson enables teachers to generate lesson plans, student handouts, exercises, and assignments from parameters provided by the user (subject, grade level, duration, pedagogical direction). All content is generated by artificial intelligence models based on the teacher's input.

3. Account Registration

  • You must be at least 18 years of age to create an account and use the service.
  • Each individual may hold only one account. You agree to provide accurate information during registration and to keep your login credentials confidential.
  • Email verification is required to activate your account.
  • You are responsible for all activity that occurs under your account.

4. Free Plan & Pro Subscription

The service offers two tiers:

  • Free Plan: 2 lesson generations to explore the platform.
  • Pro Subscription: unlimited lesson generations at $19.90 USD/month or $189.90 USD/year, with a 30-day free trial.

Payment is processed by Stripe. At the end of the free trial period, your subscription will automatically renew unless you cancel beforehand via the Stripe customer portal or your account settings page. Upon cancellation, Pro access remains active until the end of the current billing period, after which your account reverts to the Free Plan.

5. AI-Generated Content

  • All generated content is provided as a preparation aid only. It does not constitute certified pedagogical content.
  • The teacher is solely responsible for reviewing, verifying, and adapting all generated content before using it in the classroom or distributing it to students.
  • Generated content may contain inaccuracies. Draft My Lesson does not guarantee the pedagogical, scientific, or factual accuracy of any content produced.
  • You retain ownership of the content you generate and may use, modify, and distribute it freely in the context of your teaching activities.
  • By using the service, you grant Draft My Lesson a non-exclusive, royalty-free, worldwide license to use generated content in anonymized form for the purposes of improving the service, compiling statistics, and demonstrating capabilities.

6. Student Data Protection

Draft My Lesson is designed to protect student privacy:

  • Students are identified solely by pseudonyms. You must never enter the real name, address, or any other personally identifiable information (PII) of any student.
  • The teacher is the data controller for any student data. Draft My Lesson acts as a data processor for contextual pedagogical data only.
  • No student PII is transmitted to artificial intelligence models.
  • For users in the United States: you acknowledge your obligations under FERPA (Family Educational Rights and Privacy Act) and COPPA (Children's Online Privacy Protection Act). Draft My Lesson is not intended to collect personal information from children under 13, and teachers must not input such information into the service.

7. Acceptable Use

You agree not to:

  • Use the service to generate illegal, discriminatory, harmful, or otherwise objectionable content.
  • Attempt to circumvent usage quotas, rate limits, or security measures.
  • Use the service in any automated manner (scraping, bots) without prior written authorization.
  • Resell or redistribute raw AI-generated output without meaningful pedagogical adaptation or added value.

8. Disclaimer of Warranties

  • The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Draft My Lesson does not guarantee uninterrupted availability, error-free operation, or the accuracy of any generated content.
  • Draft My Lesson shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service or any content generated by it.
  • Draft My Lesson does not guarantee permanent storage of generated lessons. You are responsible for downloading and backing up your content (PDF or DOCX exports). In the event of data loss due to a technical incident, no liability shall be assumed.
  • You are solely responsible for verifying and backing up all generated content before use.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Draft My Lesson's aggregate liability to you for all claims arising out of or related to these Terms or the service shall not exceed the total amount you have paid to Draft My Lesson in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any amounts, our aggregate liability shall not exceed ten US dollars ($10.00 USD).

10. Account Deletion

You may request the deletion of your account and all associated data by contacting [email protected]. Deletion will be completed within 7 business days and is irreversible. All lessons, student pseudonyms, classes, and exported documents associated with your account will be permanently deleted.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notification within the application. Your continued use of the service after such changes constitutes acceptance of the updated Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware. Each party shall bear its own costs. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
